THE ROLE OF THE CONSTITUTIONAL COURTS IN THE PROTECTION OF THE ENVIRONMENT AND THE RIGHT TO A HEALTHY ENVIRONMENT

The Center for Legal Research and Analysis within the Project for Good Management of the Environment produced the analysis The Role of the Constitutional Courts in the Protection of the Environment and the Right to a Healthy Environment.

The analysis of the protection of the individual right to a healthy environment is based on two basic theses. First, the constitutional-legal formulation of the right to a healthy environment really makes it difficult to realize the rights of citizens and, in general, the protection of the environment and nature. Second, the lack of awareness among citizens is obvious, which directly contributes to low participation and impossible access to justice for the effective realization and protection of the essential right to a healthy environment.
