The manual for conducting a hearing in an administrative dispute is an instrument intended for administrative judges who, in accordance with the Law on Administrative Disputes, set the holding of a public hearing in an administrative dispute as a rule that enables independence and impartiality, as well as contractualism in the procedure. The manual marks a new phase of administrative decision-making, which will mean making decisions based on international practices and principles.
The manual was prepared by administrative judge Željka Zrilić Ježek from the Administrative Court of Zagreb. The process of making and adapting the Manual was positively evaluated by the judges from the Administrative and Higher Administrative Court through their participation and professional involvement in the training held at the Academy for Judges and Public Prosecutors. It contains basic and important topics for administrative judges such as preparation for a public hearing (preliminary examination of a lawsuit, delivery of a response to a lawsuit, scheduling a public hearing), principles of a public hearing (holding a public hearing, hearing witnesses and parties), presenting evidence in an administrative dispute and maintaining order.
The manual was prepared within the framework of the project “Administrative justice according to European standards”, implemented by the Center for Legal Research and Analysis, and financed by the Open Society Foundation-Macedonia.
